1. The Town of Edson recognizes that the privacy and confidentiality of a person's personal information is important. All personal information is managed according to the Alberta Access to Information Act (ATIA) and the Protection of Privacy Act (POPA) . This means that:

1. 01 You will be informed, at the point of collection, that your personal information is being collected and the purpose for which it is being collected;
1. 02 You have a right of access to your information;
1. 03 You have control over how the Town obtains, uses, and discloses your personal information;
1. 04 All uses of information are subject to you not having refused or withdrawn consent, unless disclosure is made for legal purposes.

Even if you do nothing more during your visit than browse through the web site, read pages, or download information, please be aware that the Town automatically gathers and stores certain information about your visit. This information does not identify you personally. The Town collects and stores only the following information about your visit:

2. 04 The pages you visit on the site; and
2. 05 If you are linked to the Town of Edson website from another website, the potential address of that website.

The Town uses this information to help us make our site more useful to visitors, to learn about the number of visitors to our site and the types of technology our visitors use. The Town does not track or record information about individuals and their visits.

3. The Town of Edson websites may contain links to other sites. The Town of Edson ("The Town") grants you a limited non-exclusive, non-transferable license to access and make personal, non-commercial use of the Site, provided the Site is not modified or downloaded (other than page caching) unless expressly authorized or permitted by The Town. You will be fully responsible for any consequences resulting from any use. Any unauthorized use of the Site will terminate the license and all the limited rights or permission granted by The Town.

The Town owns the intellectual property rights, including copyright, or has acquired the necessary licenses, in the information including all text, graphics, images, HTML code, multimedia clips, icons, the selection and compilation of the contents of the Site (collectively the "Contents"). The Town grants you a worldwide, royalty-free, perpetual, non-exclusive licence to use the Contents, subject to these Terms of Use. You may copy, modify, publish, translate, adapt, distribute or otherwise use the Contents in any medium, mode or format for any lawful, non-commercial, personal, or educational purpose; however, no rights whatsoever are granted in the software used to make this site available (including but not limited to any software code).

Notwithstanding anything in these Terms of Use, you are required to comply with all applicable laws, including all applicable Canadian and international intellectual property laws.

Non-endorsement

These Terms of Use do not grant you any right to use the Contents in a way that suggests any official status or that The Town endorses you or your use of the Contents.

Participation in online discussion groups, comments & other communications

You may post or submit comments, suggestions, ideas, questions, or other information (“Material”) on the Site, provided the Material is not prohibited. Material that is prohibited by these Terms of Use includes but is not limited to the following:

Illegal/criminal activity (criminal or civil violations of applicable laws, regulations, bylaws, policies, ministerial orders, or rules, including but not limited to theft or infringement of copyrights, trademarks, trade secrets, or other types of intellectual property; fraud; forgery, theft or misappropriation of funds, credit cards, or personal information; defamation; or threats of physical harm or harassment);

Security violations (attempts – whether or not successful – to violate the security of a network, service or other system, including but not limited to hacking, cracking into, monitoring, or using systems without authorization; scanning portal conducting denial of service attacks and distributing viruses or other harmful software);

Threats (materials of a threatening nature, including but not limited to threats of death or physical harm, harassment, libel, or defamation);

Offensive materials (including but not limited to obscene, profane, indecent, racist, and hateful materials); and

Any form of “spam”.

You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of such content.

If you post or submit any Material, you grant The Town an irrevocable, non-exclusive, royalty-free, right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and sub-license such use of such content or material world-wide. You fully and irrevocably waive all moral rights to such Material. You represent and warrant that you own or otherwise control all rights to any Material posted or submitted and that your Material does not violate these Terms of Use or other Town policy and will not cause injury to any person or entity; and that you will indemnify The Town for all losses, damages, fines, costs, injuries or claims resulting from Material you supply.

The Town takes no responsibility and assumes no liability for any Material posted by you or any third party. The Town reserves the right to monitor and edit or remove any activity or material or inactivate any account that appears to violate these Terms of Use or guidelines for participating in an online discussion. If you repeatedly submit or post prohibited Material, The Town reserves the right to prohibit or block you from further activity on the Site.

You are responsible for safeguarding your own password and ensuring any information you supply is accurate. The Town is not liable for any losses, damages, fines, costs, injuries or claims resulting from your failure to properly safeguard your password or supplying inaccurate information.

Limitation of liability, disclaimer of warranties and conditions

The Contents and any services are provided in good faith on an "as is" basis and were current at the time of posting for use on the Site. The Town and its third party provider who hosts/develops the Site are not required to provide regular or any updates to the Contents or format of the Site.

The Town and its third party provider who hosts/develops the Site disclaim all warranties or conditions, express or implied, in respect of the Contents and any services considered by these Terms of Use, including without limitation, implied warranties and conditions of merchantability and fitness for any particular purpose, non-infringement or accuracy. This disclaimer applies to the fullest possible extent in jurisdictions that limit the exclusion of implied warranties.

The Town and its third party provider who hosts/develops the Site are not responsible for any liability of any kind for any direct, indirect, incidental, consequential or other losses, damages, fines, costs, injuries or claims resulting from the use, misuse or misinterpretation of any Content or services provided by this Site.

Indemnity

You agree to indemnify, defend and hold harmless The Town and its third party provider who hosts/develops the Site and their respective officials, officers, employees and authorized representatives, as applicable, from and against any liability, loss injury (including injuries resulting in death), demand, action, cost, expense, or claim of any kind, including but not limited to lawyer's fees, relating in any way to your use of the Contents or any services provided by this Site.

We reserve the right to make changes to our Site, policies or Terms of Use and provide any additional terms at any time. The Town is subject to the Alberta Access to Information Act (ATIA) and the Protection of Privacy Act (POPA).

The Town and its third party service provider who develops/host the Site may collect aggregate, anonymous transactional and performance data related to the use of the software and use such data for business purposes (including use optimization of the software and product marketing), but will not reveal the identity of any user of the Site, including you.
